Texas banned motorcycle lane splitting in 2023, a change that significantly affected how adjusters judge fault in highway crashes. Riders often filter between slow cars to avoid rear-end collisions; however, state law now classifies this act as a moving violation. Because the state bans lane splitting, motorcyclists who split lanes face difficult hurdles when seeking compensation for crash injuries.
The State Ban On Filtering Through Traffic
Under the Texas Transportation Code, motorcyclists are subject to specific lane rules. The law specifically targets certain riding habits to keep roads safe.
A rider breaks state traffic rules if they perform these exact acts:
- Riding between lanes: Operating a motorcycle on the striped lines between traffic lanes.
- Passing in the same lane: Passing a car or truck inside the same marked lane.
- Filtering at lights: Moving to the front of stopped vehicles at a red light.
These rules apply regardless of traffic congestion or vehicle speed. When a crash happens during one of these maneuvers, the traffic violation shifts the fault against the rider.
How Adjusters Use Proportionate Responsibility
Insurance adjusters evaluate the state traffic code to assess fault after a crash. Texas follows a proportionate responsibility rule for injury claims, which prevents an injured person from recovering damages if they are more than 50 percent at fault.
If a police report shows a rider was splitting lanes, the insurance adjuster may argue that the illegal move contributed to the crash. Even if the car driver operated their vehicle poorly, the traffic violation can increase the rider’s assigned fault share. Assigning a large share of blame to the rider effectively lowers the final payout.
Evaluating Fault When Both Drivers Make Mistakes
Many crashes involve shared mistakes instead of a single at-fault driver. For example, a motorcyclist might ride between lanes just as a car driver merges without signaling. In these cases, the legal review focuses on dividing the blame between both parties.
Data from the National Highway Traffic Safety Administration shows that the majority of multi-vehicle motorcycle crashes occur when other drivers do not see the motorcyclist. Adjusters and courts review dashcam footage, witness statements and vehicle damage to determine exactly how the crash occurred. Proving the car driver initiated the crash limits the rider’s share of the blame, which decides the financial outcome of the claim.
The Impact Of Shared Fault On Recovery
The 2023 lane splitting ban changed motorcycle claims in Texas. While filtering through stopped highway traffic might feel safer for a rider, the legal system views it as a direct traffic violation. This classification gives insurance adjusters grounds to contest fault and argue for shared responsibility. Successfully recovering medical costs depends on proving that the other driver was primarily at fault.
